Increased Medical Malpractice Risk in Next Generation ACO Model?

Day Pitney healthcare attorney Susan Huntington authored an article titled “The CMS Next Generation ACO Model – Will It Increase Medical Malpractice Risk?” for the May issue of Accountable Care News. The article analyzes the “Next Generation ACO Model,” previously discussed here and here, which was recently created by the Innovation Center at the Centers for Medicare & Medicaid Services.

The Next Generation ACO Model permits participants in accountable care organizations (ACOs) to assume a higher level of financial risk and reward than is currently available in other Medicare ACO initiatives, including full capitation. Susan discusses whether this and related changes, intended to increase the attractiveness of participating in an ACO, will create additional medical malpractice exposure for participants.
